Penalties Are Steep
The penalties a defendant will face depend on various factors, including blood alcohol level (BAL) and any prior DUI offenses (even from another state).
- First conviction. You can face a maximum $1,000 fine and up to six months in jail as a first-time offender. If your BAL was 0.15 or higher, then penalties increase to a maximum $2,000 fine and up to nine months in jail.
- Second conviction. A maximum $2,000 fine and nine months in jail. If you have a high BAL, then a maximum $4,000 fine and 12 months in jail.
- Third conviction (within 10 years of second conviction): Maximum $5,000 fine and 5 years in prison, with 30 days mandatory imprisonment. This is a felony charge in Florida.
- Fourth conviction: Maximum 5 years in prison and fines. Repeat offenders may ultimately lose their license permanently because they are a habitual offender and a danger to others.
