Can You Seal Your Criminal History?

Not everyone is eligible to seal or expunge, and the process is complicated. Here are the most important steps:

  1. Meet with our office to review if you are eligible. Florida allows people to seal or expunge only certain offenses. Consult an experienced attorney to see if you qualify.
  2. Fill out paperwork. You must complete certain forms and submit them for approval. Although you could do this on your own, any mistake will delay the process or result in a denial. Have a lawyer fill them out to ensure completeness and accuracy.
  3. Submit forms to the appropriate office. We will submit your completed forms to the State Attorney’s Office, along with the Department of Law Enforcement. They will need to review and issue a certificate showing you are eligible.
  4. Submit a petition to the court. The courts oversee the process for sealing or expungement. We can submit your petition to the correct court with your Certificate of Eligibility.
  5. Wait for the Attorney’s Office to respond. They might object, in which case we will need to schedule a hearing before the court.
  6. Present evidence to the court. Our attorney can argue to the court why your record should be sealed or expunged. If the state objects, they can also make their case, which we will respond to. It is up to the judge to grant relief.
